Object of the contract
It is the purchase and sale of goods published on the pages of the website www.officinatonazzo.it. Orders can be sent through our website, by fax by filling in the appropriate order form and sending it to +390498842722, finally by telephone at +390497966511. All prices displayed on our site include VAT and they may be subject to change without notice. Shipping and payment can be made in various ways, as indicated below, at the Customer's choice.
It is possible to collect it from our warehouse located in via del Santo 174 in Limena (PD), by telephone agreement. In this case the shipping costs will not be charged.
Barto Sas di Barzelogna Luca reserves the right to modify the description of the goods themselves, as well as the conditions of sale published on this site, without prejudice to the validity of the contracts already duly concluded before the modification.
The online or telephone purchase procedure immediately generates the activation of a purchase proposal by the user. Barto Sas di Barzelogna Luca, in the case of orders sent through the web, will automatically send by email the confirmation of receipt of the aforementioned proposal and the information documentation required by art. 52 of the Legislative Decree 6 September 2005 n. 206, relating to the protection of the consumer in respect of distance contracts.
ATTENTION: in the event that you place an order via web or telephone and you choose the method of payment by cash on delivery (cash payment to the courier), and at the time of delivery you refuse it without first contacting Barto Sas promptly via email at firstname.lastname@example.org address, or on the phone at +390497966511, the expenses for the out-of-pocket costs incurred will be charged, which include shipping costs - storage costs - return of goods, for a total equivalent to € 20,00. The same conditions apply when the courier is unable to deliver the goods due to an incorrect or incomplete destination address.

For all payment methods, shipping within the national territory (excluding islands) normally takes place within 24/72 hours, always and in any case if the payments have been credited, if the goods are available at the time of the order and if the order procedure has been completed successfully (see order confirmation email).
If you have placed an order by choosing payment via Paypal and for some reason the transaction was not successful, you can request a direct payment link by sending an email to email@example.com specifying your order number and any other details .
ATTENTION: payments sent autonomously, not corresponding to the actual total of the ordered goods (e.g. lack of shipping costs if requested, collection costs or other) and without any communication to the company, involve only and exclusively delays in processing of the order.
Web prices, Vespaclub discounts or price lists reserved for workshops / resellers, are ALWAYS VALID, are not retroactive and cannot be applied to orders already sent. Purchases made directly at our sales counter are subject to web, Vespaclub or reseller prices, depending on the buyer's price list.
READ WELL: Sales invoices they are not issued automatically and must be requested at the time of the order, always and only for orders with an amount equal to or greater than 80,00.

REFUNDS: To request a refund on the purchased goods, it is necessary to promptly communicate to Barto Sas all tax data and details relating to the order. The refund will be sent using the same payment method chosen to finalize the order and will be made by the administration.
The refund itself is not immediate but follows administrative times that can last up to a maximum of 30 days.
By sending an order to Officina Tonazzo / Barto Sas, you accept the conditions of sale in their entirety and also take note of the timing for refunds.
WARRANTY AND RETURN OF PRODUCTS
Pursuant to art. 128 and ss. Legislative Decree of 6 September 2005 n. 206, the guarantee reserved only for private consumers is 2 years, while for purchases made by professionals with a VAT number, the rules provided for by the Civil Code are applied and the guarantee has a duration of 12 months.
For the warranty to be valid, the product must have been used correctly, respecting its intended use and as provided in the attached documentation; it can only be exercised if you are in possession of the original shipping documents. Parts subject to wear are exempt from warranty.
The warranty and / or replacement of the products lapses in cases where:
The products have been installed or assembled by unqualified personnel;
The products have not been used according to the parameters established by the manufacturer;
The products are tampered with;
The products are not intact;
The products are not intact;
The products do not carry the warranty label with the serial number;
The products do not have their original packaging, accessories and manuals;
The products have been sent with approximate packaging and due precautions have not been taken to prevent one or more parts from colliding with each other, creating defects;
The original packaging is damaged and therefore can no longer be used to resell the goods contained therein;
The products have been subjected to electrical discharges and voltages that do not comply with the characteristics of the product, described in the manual or on the reference plates;
The products have undergone unauthorized modifications and / or do not comply with the Manufacturer's specifications;
Failures or defects were caused by extraneous parts and / or resulting from conflict with additional components within the same package;
The products have been subject to intervention carried out by customers without prior authorization;
The products in question are electrical spare parts already installed.
To receive assistance during the warranty period, it is necessary to send an email to email@example.com indicating the nature and characteristics of the defect found and attaching all the purchase documentation (transport document, etc.)
The products must arrive exclusively in their original packaging; improper or improper packaging voids the warranty conditions. Each product must arrive complete with the original kit (wiring, manuals, software, etc.) and the original transport documents.
The lack of the kit implies the incomplete product, therefore it will not allow the exchange of the product itself if it is considered not repairable and therefore replaceable. To limit damage to the original packaging, we recommend, whenever possible, to put it in a second box; in all cases, the affixing of labels or adhesive tapes directly on the original product packaging should be avoided.
Any arrival of the goods not previously authorized will be strictly not accepted and rejected. In the event of a lack of conformity, Barto Sas will, at no cost to the Customer, except for transport costs, restore the conformity of the product by repairing or replacing the product, or to reduce the sale price or terminate the contract, with consequent return of the amount paid by way of consideration.
If, following intervention by an Authorized Service Center, the defect does not result in a lack of conformity pursuant to Legislative Decree of 6 September 2005 n. 206, the Customer will be charged for the verification and restoration costs required by the Authorized Assistance, as well as the transport costs, if they have been incurred by Barto Sas di Barzelogna Luca.

RIGHT OF WITHDRAWAL
The consumer, in accordance with the Legislative Decree 6 September 2005 n. 206, has the right to withdraw from any distance contract, without any penalty and without specifying the reason within and no later than 14 working days from receipt of the goods. This right can be exercised only by those who purchase as natural persons for personal purposes not attributable to their work activity. The right of withdrawal is exercised, according to the provisions of art. 73, paragraph 5 of the Legislative Decree 6 September 2005 n. 206, by sending, within the prescribed period, a registered letter with return receipt addressed to Barto Sas di Barzelogna Luca via del Santo 174, 35010 Limena (PD). After receiving the communication, we will contact the customer to inform him of how to return the goods.
As required by art. 67 paragraph 3, the product is returned to the sender at the expense of the consumer. No reimbursement is provided if the goods are not intact, in their original container or wrapping with adequate external packaging, if they are used or altered, if the original accessories and documentation are missing and if they are not provided with the original transport documents.
Returns that are not agreed upon are not accepted. The shipment, up to the certificate of receipt in our warehouse, is under the complete responsibility of the customer. In case of damage to the goods during transport, Barto Sas di Barzelogna Luca will notify the customer of the incident (within the 5th day of receipt of the goods in their warehouses), to allow him to promptly file a complaint against the courier from him. chosen and obtain reimbursement of the value of the asset (if insured); in this case, the product will be made available to the customer for its return, at the same time canceling the request for withdrawal.
Barto Sas di Barzelogna Luca is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments. Upon its arrival at the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the package and / or the original packaging are damaged, Barto Sas will deduct a percentage from the refund due, in any case not exceeding 10% of the same, as a contribution to the restoration costs.

Pursuant to Legislative Decree No. 196/2003, Barto Sas di Barzelogna Luca informs you that the processing of your data will take place with the sole purpose of proceeding with the execution of the contract. Your data will therefore necessarily be transmitted to the shipping company with which we operate. The consent to the processing of data is necessary in order to execute the sales contract. This consent will give Barto Sas di Barzelogna Luca the right to inform you in the future about news, promotional discounts and initiatives. Adherence to this processing method is optional.
